A Resolution in Honor of Beverly's 2026 Senior of the Year

presented by the Beverly City Council with great appreciation for the volunteerism, community-mindedness, and caring of our esteemed honoree

Whereas Gail Dionne, a long-time part of the Beverly community for more than fifty years and a resident of the City's wonderful Ward 3, has been named this year's Beverly Senior of the Year;

Whereas Gail moved from Salem, MA to the City of Beverly with her late husband John to put down roots, to nurture and raise their family, and to become fully and generously a part of the community;

Whereas Gail was a dedicated part of the Beverly Public Schools team for many years, forging strong relationships with students and their families, as well as with her colleagues;

Whereas Gail and John shared a love of being on the water and, especially, of sailing, spending years as beloved members of Salem's Palmer Cove Yacht Club and loving times when they could feel the thrill of the wind in the sails and having the boat heeled over well, whether on a casual sail, or when on a beat, a reach, or a run to make the next mark in a sailboat race;

Whereas Gail is extremely generous with her time and with her deeply caring heart, and is always the first one to step up to offer help when someone needs a ride to an appointment or to the grocery store, or when someone simply needs a caring and listening ear or an invitation and encouragement to attend an event or activity at the Beverly Senior Center in a time of feeling alone or isolated;

Whereas Gail is an active and engaged member of the Beverly Senior Center community – a joyful regular part the bocce team, leader of the exercise class, active participant in walking club and in the Mah Jong group, helper in the kitchen, ready hand to help serve up the pizza for a fun-filled movie night, and an overall dedicated volunteer and welcoming face for the many activities and events that offer so many connections to and for others at the Senior Center;

Whereas Gail, with her generous spirit and caring heart, embodies in every way the idea of generous volunteer leadership; Gail is always ready to help when and where she is needed, helping to build and strengthen a sense of community and communal care as she does so, while giving with her whole heart for its own sake, without expectation of recognition or anything in return; and

Whereas Gail truly exhibits the community pride and caring, the sense of leadership, and joy in sharing kindness and giving of herself in service to others that embodies true volunteerism and generosity of spirit;

NOW THEREFORE, BE IT RESOLVED that the Beverly City Council does hereby congratulate, thank, and honor Beverly's 2026 Senior of the Year, Gail Dionne, and wishes her much happiness, success, and good health, and orders that the City Clerk spread a copy of this Resolution upon the City Records.

Dear Honorable Council:

I am pleased to inform you that the City of Beverly has been awarded a $66,590.90.90 grant from the U.S. Department of Homeland Security (DHS)/Federal Emergency Management Agency (FEMA) - Assistance to Firefighters Grants (AFG) Program for the Fire Department.

Grant funding will be used to add an additional Source Capture Exhaust Systems (SCES) to the Central Fire Station and update existing SCES components in all three fire stations (Central, North Beverly & Beverly Farms). Currently, there are two apparatus that are housed at the Central Fire Station that do not have SCES and the remaining SCES throughout the three stations are over 30 years old and need updating. The addition of the SCES will allow the department to adhere to NFPA 1500 National Fire Protection Association (NFPA) Standards. This grant award requires a 10% match of $6,659.10 which is budgeted in the Fire Department budget. Total project budget is $73,250.

The Assistance to Firefighters Grants (AFG) program is designed to enhance the health and safety of public and firefighting personnel and to provide support for emergency responders regarding fire, medical, and hazard events. Since 2001, AFG grants have provided firefighters and first responders with critically needed resources necessary for protecting the public and emergency personnel from fire and related hazards.

Massachusetts General Law Chapter 44 Section 53A requires both City Council and Mayoral approval before any grant, earmark, donation, or gift to the City can be expended for their prescribed purpose. Dear Honorable City Council:

We respectfully submit the attached proposed order and zoning amendment and request that the City Council refer this matter to the Planning Board within 14 days and schedule a joint public hearing with the Planning Board, or separate public hearings, at your earliest convenience.

The goals of this proposed temporary moratorium are to give the City time to undertake the following actions:

  • Better understand the impacts, if any, that the construction, expansion, and operation of Data Centers will have on public safety, electrical demand, water, sewer, and roadway infrastructure, noise, environmental resources, and the overall community character, or any other impacts identified.
  • Prepare appropriate and reasonable regulations for Data Centers that consider any impacts identified in the analysis or study.

We look forward to discussing this proposal at a future public hearing(s), which may be scheduled by the City Council alone or jointly with the Planning Board. Pursuant to M.G.L. Chapter 40A, Section 5, the City Council shall forward any zoning amendment to the Planning Board within 14 days and each of the Planning Board and City Council, jointly or separately, shall hold a public hearing within 65 days from when the ordinance amendment is submitted to the Planning Board.

Enclosures

In the year two thousand and twenty-six

Be it ordained by the City Council of the City of Beverly as follows:

City Ordinance Chapter 300 is amended by inserting a new section to be titled Section 300-142 "Temporary Moratorium on construction of Data Centers until November 30, 2027" the purpose of which is to adopt a temporary moratorium on the use, construction, development, expansion, or conversion of land or structures for Data Centers. During the moratorium period, the City shall not accept, process, or approve any application for a Data Center, including but not limited to Building permits; Special permits; Site plan approval; and any other zoning or land use approvals.

The new section shall read as follows:

Article XVII

Section 300-142

Temporary Moratorium on construction of Data Centers until November 30, 2027.

1. Purpose.

The purpose of this temporary moratorium is to provide the City an opportunity to better understand the impacts, if any, that the construction, expansion, and operation of Data Centers (defined below) will have on the City of Beverly. As a result, the City shall analyze and study the impacts of said construction on public safety, the school district, electrical demand, water, sewer, and roadway infrastructures, noise, environmental resources and the overall community character.

Currently, Chapter 300 of the City's General Code (the City's Zoning Ordinances) does not identify Data Center as a permitted use, nor are there specific restrictions on such use. The regulation of Data Centers raises novel and complex legal, planning, and infrastructure issues or concerns. The City needs time to study, consider, and engage in decision-making regarding this new use and the potential impacts of the use and to undertake a planning process to develop appropriate and reasonable regulations for Data Centers, consistent with M.G.L. c. 40A.

The City hereby adopts a temporary moratorium, effective immediately, on the use of land and structures and any new construction and development in the City of Beverly for Data Centers in order to allow the City sufficient time to engage in a planning process to address the effects of such structures and uses in the City and to adopt provisions of the Zoning Ordinances in a manner consistent with sound land use planning goals and objectives.

2. Moratorium.

The City of Beverly hereby adopts a temporary moratorium on the use, construction, development, expansion, or conversion of land or structures for Data Centers. During the moratorium period, the City shall not accept, process, or approve any application for a Data Center, including but not limited to:

  • Building permits;
  • Special permits;
  • Site plan approval;
  • Any other zoning or land use approvals.

3. Definitions.

DATA CENTER(S): a building or group of buildings, the primary use of which is to house computer systems, servers, data storage equipment, networking equipment, and associated infrastructure necessary for the processing, storage, and distribution of data and digital applications.

4. Intent.

For the reasons set forth in the purpose Sections above, and notwithstanding any other provision of the Zoning Ordinance to the contrary, the City hereby adopts a moratorium on the use of any land or structure for Data Centers in all zoning districts in the City. The moratorium shall be in effect until such time that the City Council enacts a Zoning Ordinance specifically addressing Data Centers in the City of Beverly or through November 30, 2027, which date is sooner. During the moratorium period, the City shall undertake a planning process to evaluate the potential impacts of Data Centers and related uses in the City, consider public health and safety implications, if any, of Data Centers, consider the appropriate locations within the City, if any, for Data Centers, review and consider State regulations and case law, and develop and enact new Zoning Ordinances to address these issues, including the use of any land or structures therefore.

5. Severability.

The provisions of this ordinance are severable. If any provision, paragraph, sentence, or clause of this ordinance or the application thereof to any person, establishment, or circumstances shall be held invalid, such invalidity shall not affect the other provisions or application of this ordinance.

This section shall apply to any person engaged in the business of conducting such sales or auctions of second hand motor vehicles and who, as an incident to such business, sells or shall sell such lease or rental vehicle to the public. All sales of second-hand motor vehicles and parts thereof made by any person referred to in this section shall be reported to the registrar of motor vehicles as prescribed by him.

(c) Class 2. A person whose principal business is the buying or selling of second hand motor vehicles for resale in retail transactions, and any other person who purchases second hand motor vehicles not owned by him and who agrees in an agreement in which he receives compensation, whether solely for displaying the vehicles, upon the sale of each vehicle, or otherwise, may be granted a dealer's license and shall be subject to the following condition:

Every bond shall also provide that no suit may be maintained to enforce any liability on the bond unless brought within 1 year after the event giving rise to the cause of action.

(3) The surety shall not be exhausted by the payment of claims described in clauses (i) to (vi), inclusive, of paragraph (1). The surety on a bond shall not be liable for total claims in excess of the bond amount, regardless of the number of claims made against the bond that remained in force.

(4) A separate bond shall be required for each different name under which the dealer conducts his business in the state in which the dealer has a place of business.

(5) In lieu of the bond required by this section, the municipal licensing authority may allow the dealer to deposit collateral in the form of a deposit of letter of credit, as authorized by the banking laws of the commonwealth, which has a face equal to the amount of the bond otherwise required. The collateral may be deposited with or exceed through any authorized state depository designated by the commonwealth. Interest on the certificate of deposit shall be payable to the dealer who maintains such collateral, or to a person as the dealer or the certificate may direct.

(6) A surety shall provide to the municipal licensing authority notice of cancellation of this bond within 30 days of the cancellation.

(7) Upon receipt of notification from a surety that a bond has been cancelled, the municipal licensing authority shall notify the licensee that he has 10 days to comply with the new requirement. (8) A municipal licensing authority shall not issue or renew under this Class 2 license unless it is satisfied that a bond or equivalent proof of financial responsibility meeting the requirements of this section is in effect and while the license remains in force shall demonstrate access to repair facilities sufficient to enable him to satisfy the warranty repair obligations imposed by section 7N1/4 of chapter 90. A used car dealer shall remain liable for all warranty repairs and other obligations imposed by said chapter 90.

(d) Class 3. A person whose principal business is the buying of second hand motor vehicle parts or the dismantling, taking apart or rebuilding and selling the same, or the assembling of second hand motor vehicle parts to be granted a dealer's license.

RE: Beverly Homeowner Rehabilitation Program update and request to share the program availability

Dear Honorable City Council:

The Beverly Homeowner Rehabilitation Program (BHRP), funded through the Community Development Block Grant (CDBG), is up and running. Our partner, Essex County Habitat for Humanity, has approved several families. The housing rehabilitation specialist is inspecting properties, writing up the scope of work, and finding skilled tradespeople to bid on the work. Work includes replacing decks, lead paint removal and abatement, electrical and plumbing upgrades, roofing work and other important code violations.

The BHRP provides no interest, no payment, 15-year forgivable loans to low-income households who need financial and technical support to make critical code and accessibility related improvements to their homes. One- to four-unit properties are eligible with owner occupancy.

Funds are still available for eligible properties throughout the City. Would you please help get the word out to your constituents? Please see the attached flyer and FAQ for more information, call us at 978-605-2346, or see the News Flash on the city's website. The application may be downloaded at any of these locations or at our partner's website at https://www.essexcountyhabitat.org/beverly-housing-rehab/.

Thank you for your attention. We appreciate your assistance.

Sincerely,

Stephanie Harrington Community Development Grant Manager

CITY COUNCIL

September 30, 2026

The Honorable City Council Beverly City Hall 191 Cabot Street Beverly, Ma 01915

Dear Honorable City Council,

I am writing to request that the Parking and Traffic Commission review the current conditions along Essex Street and Cole Street in Centerville and provide recommendations to improve public safety.

I have become increasingly concerned about safety along Essex Street and Cole Street as numerous residents have reached out to me recently with concerns about safety at various locations. Residents are concerned about the volume of vehicles pulling in and out of the YMCA Sterling Center driveway, they have told me about "near misses" at the crosswalk at Essex Street and Cole Street, they are concerned about speeding all along both Essex Street and Cole Street, they talk about the danger of crossing the street at the intersection of Essex Street and Groce Street, and further along Essex Street where there are no sidewalks or crosswalks they are concerned about their children crossing the street safely to get to the bus stop.

Due to the volume of concerns raised by residents who often site "close calls" with pedestrians, I feel it is critical that the Parking and Traffic Commission review these roadways and provide recommendations to the City Council and the Administration on what can be done to make improvements to the current conditions.

Thank you for your consideration.

Sincerely,

Matthew St. Hilaire Ward 6 City Councilor & City Council Vice President

CITY COUNCIL

September 23, 2026

The Honorable City Council Beverly City Hall 191 Cabot Street Beverly, Ma 01915

Dear Honorable City Council,

Please find enclosed a draft City Ordinance designed to provide the City Council authority to review and approve all out-of-state travel by the Mayor and/or any member of the Administration.

During the FY26 City Budget discussions earlier this year, I proposed eliminating the Mayor's Travel & Expense line items as part of an effort to close the budget deficit and to bring City spending in line with revenues. Given the City of Beverly's financial challenges, I continue to believe that these out-of-state trips are an inappropriate use of taxpayer funding.

A news article written in 2024 cited Mayor Cahill has having the 2nd highest out-of-state travel expenses of any Mayor in Massachusetts citing trips to Washington, D.C., Kansas City and Miami Beach.

What is the public benefit of the Mayor of Beverly attending these out-of-state conferences? What expenses does the Mayor incur that are paid by the taxpayers of Beverly? Is this the best use of the Mayor's time and our taxpayer resources considering our City's financial crisis? Our residents are struggling with affordability issues and they deserve to know that answers to these questions.

Over the years, I've heard many City Councilors lament our "strong Mayor" from of government and the limited authority of the City Council. This ordinance is within our authority and gives the City Council a tool to provide increased oversight of the Mayor on behalf of our residents.

Thank you for your consideration.

Sincerely,

Matthew St. Hilaire Ward 6 City Councilor & City Council Vice President

An Ordinance Amending Chapter [X], Section [Y] of the Ordinances of the City of Beverly Regarding Executive Administration Out-of-State Travel and Expenditure of Public Funds.

Be it ordained by the City Council of the City of Beverly as follows:

Section 1. Purpose and Intent

The purpose of this ordinance is to establish strict fiscal accountability, oversight, and transparency regarding out-of-state travel by the executive administration. This ensures that all travel paid for by municipal funds serves an essential public purpose with a clear and defined benefit to the City of Beverly.

Section 2. Definitions

  • "Administration" or "Executive Administration": Shall mean the Mayor, their direct appointees, department heads, and all employees operating under the authority of the executive branch.
  • "Out-of-State Travel": Travel to destinations outside the geographical boundaries of the Commonwealth of Massachusetts.

Section 3. Prior Approval Required for Out-of-State Travel

  1. City Council Authorization: No public funds shall be expended, nor shall any member of the Executive Administration be reimbursed, for out-of-state travel unless such travel has been approved by a majority vote of the City Council at a regularly scheduled meeting.
  2. Submission Timeline: A formal written request for out-of-state travel must be submitted to the City Clerk for inclusion on the City Council agenda no less than fourteen (14) business days prior to the scheduled departure.

Section 4. Content of Travel Request

Any request for out-of-state travel submitted by the Administration must include a completed Travel Authorization Form detailed with:

  1. The name and title of the municipal employee(s) traveling.
  2. The destination, dates of travel, and the specific event, conference, or municipal business being conducted.
  3. An itemized estimate of all associated costs, including transportation, lodging, registration fees, and meals.
  4. A written justification detailing the direct benefit of the travel to the operations of the City of Beverly.
  5. The specific municipal account and line-item from which the travel will be funded.

Section 5. Limitations on Travel and Reimbursements

  1. Funding Source Restrictions: In accordance with M.G.L. c. 268A, no member of the Administration shall accept direct vendor-paid travel or accommodation subsidies unless expressly authorized by a specific local ordinance regulating vendor payments or accepted as a formal grant under M.G.L. c. 44, § 53.

CITY COUNCIL

September 30, 2026

The Honorable City Council Beverly City Hall 191 Cabot Street Beverly, Ma 01915

Dear Honorable City Council,

Please find enclosed a draft City Ordinance designed to provide the City Council greater oversight and authority in approving any contract, lease, or agreement for services, supplies, or equipment for a term exceeding three (3) years, inclusive of any options.

On June 15th, Mayor Cahill announced to a group of about 100 residents gathered at the McKeown Building that he signed a 5-year contract with Casella Waste earlier that day, for a new automated trash and recycling program that would begin on July 1st – just two weeks later. Notably, the 5-year contract was signed without prior City Council approval or funding authorization. And the expiration date on the contract the Mayor signed extends to June 30, 2031, well beyond the end of Mayor Cahill's current 4-year term.

As a City Council member, sitting in the audience, I was unaware of the details related to the contract and was learning in real time along with my fellow residents. This announcement came less than two weeks after Mayor Cahill introduced his FY26 Proposed Budget and just eight days before the City Council approved the FY26 Budget on June 23rd by a 5-4 vote.

The new trash and recycling program, along with the 300% increase in the Trash Fee continues to be the subject of extensive public discussion. I have heard from numerous residents who are outraged at the complete lack of transparency, and poor communication related to what was an important decision that impacted their day-to-day lives and personal finances.

While the City Charter provides the Mayor authority to sign contracts on behalf of the City, this this draft City Ordinance is intended to mirror and implement the local option of the Uniform Procurement Act, M.G.L. c. 30B, § 12 which provides the City Council approval authority on contracts greater than 3 years in length.

Thank you for your consideration.

Sincerely,

Matthew St. Hilaire

AN ORDINANCE AMENDING THE BEVERLY CITY CODE, CHAPTER 49, PROCUREMENT AND CONTRACTS, TO ALIGN CITY CONTRACT TERM LIMITS WITH MASSACHUSETTS GENERAL LAWS CHAPTER 30B, SECTION 12.

Be it ordained by the City Council of the City of Beverly as follows:

SECTION 1. The Beverly City Code, Chapter 49, entitled "Procurement/Contracts," is hereby amended by adding a new Section, to be numbered appropriately by the City Clerk, or by amending the relevant existing subsection, to read in its entirety as follows:

§ 49-X. Term Limits for Services, Supplies, and Equipment Contracts; Council Authorization.

(A) Maximum Term and Council Approval. No city official, including the Mayor, shall execute any contract, lease, or agreement for services, supplies, or equipment for a term exceeding three (3) years, inclusive of any options to renew or extend, without explicit authorization via a majority vote of the City Council.

If funds are not appropriated or otherwise made available to support continuation of performance in any fiscal year succeeding the first year, the contract shall be cancelled.

SECTION 2. All ordinances or parts of ordinances inconsistent herewith are hereby repealed.

SECTION 3. This ordinance shall take effect upon its passage and publication as required by law and the City Charter.

Petition to Install and Maintain Fiber Optic Facilities

Date: September 29, 2026

To: The City of Beverly 191 Cabot St. Beverly, MA 01915

From: CRC Communications, LLC d/b/a GoNetspeed 56 Campus Dr. New Gloucester, ME 04260

Location: Starting at Approximately: 9 Virginia Ave. Beverly, MA 01915

CRC Communications, LLC d/b/a GoNetspeed respectfully petitions the Beverly City Council for permission to install and maintain underground fiber-optic facilities within the public right-of-way.

This request is made pursuant to M.G.L. c. 166, § 22, which authorizes municipalities to grant locations for conduits and other telecommunications fixtures, and Beverly Code Chapter 253, which governs the placement, construction, and maintenance of underground facilities in public streets and ways (including §§ 253-13, 253-14, and 253-15).

GoNetspeed further notes that federal law, specifically 47 U.S.C. § 253(a) of the Telecommunications Act of 1996, prohibits state or local legal requirements from having the effect of preventing a telecommunications provider from offering service. Municipal review of conduit placement is required, but it must remain competitively neutral and not operate as a barrier to entry.

Project Description:

Starting at pole # 75 (42.554153°, -70.907126°) on Virginia Ave., GoNetspeed proposes to bore approximately 295' southwest and terminate at pole # 4208 (42.553834°, -70.907673°) on Virginia Ave.

The project consists of installing 2" HDPE conduit at a depth of approximately 24" to house fiber optic cable. This underground segment is required to strengthen network resiliency, improve route diversity, and support reliable service throughout Beverly.

Please see the attached plan set for additional detail. I'm available at any time should the Council require further information or clarification.

Respectfully submitted,

Benjamin T. Madden OSP Licensing & Permitting Specialist benjamin.madden@gonetspeed.com 56 Campus Dr., New Gloucester, ME 04260

Petition to Install and Maintain Fiber Optic Facilities

Date: September 29, 2026

To: The City of Beverly 191 Cabot St. Beverly, MA 01915

From: CRC Communications, LLC d/b/a GoNetspeed 56 Campus Dr. New Gloucester, ME 04260

Location: Starting at Approximately: 6 Charles St.

Starting at pole # 5405 (42.558839°, -70.881412°) on Charles St., GoNetspeed proposes to bore approximately 310' southwest and terminate at pole # 850 (42.558268°, -70.882083°) Beckford St.

Location: Starting at Approximately: 32 New Balch St.

Starting at pole # 795 (42.566533°, -70.892320°) on New Balch St., GoNetspeed proposes to bore approximately 310' northwest and terminate at pole # 3449 (42.566704°, -70.893234°) on Jenness St.

The project consists of installing 2” HDPE conduit at a depth of approximately 24” to house fiber optic cable.

City of Beverly CITY COUNCIL

January 28, 2026

The Honorable City Council Beverly City Hall 191 Cabot Street Beverly, Ma 01915

Dear Honorable City Council,

We are writing to request that the City Council hold a Public Meeting on the City's utilization and plan for Camp Paradise, located at 44 Cole Street in Beverly.

Camp Paradise is a 12-acre property that was bought by the City in 2015 for $950,000 through a combination of community preservation money, state grants, and the Beverly Park and Recreation Department's budget. The original acquisition dictates that the land remains for the purposes of "conservation, scientific study, and nature recreation." There is a 1,000-square-foot recreation building on the site as well as a biodiverse environment that includes a red maple swamp, woodlands, a pond, and a couple of vernal pools.

A recent Salem News article highlighted a proposal for the creation of the nature learning center at the site. Camp Paradise is protected by Article 97 of state law, and the article indicates the Administration has concerns about the proposal, with Mayor Cahill quoted as saying:

"The land is protected by Article 97 of the Constitution of the Commonwealth, and the priority remains the needs of the city," Cahill said in a statement. "At this time, the city is satisfied with the current programming and is not interested in changing the use of the space. A use of the land that could be interpreted as a lease of the land could be considered a disposition."

We have heard from residents in the neighborhood and beyond who believe that Camp Paradise is an underutilized City resource and represents a tremendous opportunity to promote conservation and nature education programming among Beverly's youth.

We would like to have a public discussion with Mayor Mike Cahill, Director of Recreation Bruce Doig and City Solicitor Beth Oldmixon, to help residents better understand what uses are permitted at Camp Paradise and what the plan is for the site moving forward.

Thank you for your consideration. Sincerely,

Matthew St. Hilaire Ward 6 City Councilor & City Council Vice President

Kestrel, mayor at odds on creating nature learning center at Camp Paradise

By Michael McHugh | Staff Writer Jan 9, 2026

Jessica Kagle of Kestrel Educational Adventures is proposing a nature learning center at Camp Paradise, a 12-acre property off Col Street that was bought by the city of Beverly in 2015. By Michael McHugh/Staff Writer

BEVERLY — A natural science education organization and community members are pushing for the creation of a nature learning center at Camp Paradise in Beverly, but the city claims that legal restrictions on use of the land would make the proposed use infeasible.

Camp Paradise is a 12-acre property on Cole Street that was bought by the city in 2013 for $950,000 from Girl Scouts of Eastern Massachusetts through a combination of community preservation money, state grants, and the Beverly Park and Recreation Department's budget.

Although the property had been appraised to be able to accommodate residential and commercial development, the original acquisition document dictates the land will remain for the purposes of "conservation, scientific study, and nature recreation."

In addition to a 1,000-square-foot recreation building, the site includes a red maple swamp, woodlands, a pond, and a couple of vernal pools — with the intersecting environments creating a high level of biodiversity for such a small property.

Kestrel Educational Adventures, a nature science education organization that frequently utilizes and rents out the space, has a "conservation club" program designed for students aged 10-16. The conservation club has conducted a service project to explore the ponds and collect data to submit to the state and the city's own conservation staff, to aid in the understanding and protection of the sensitive breeding wildlife onsite.

Through its study of local wildlife through trail cams and direct observation, the club has found evidence of wood frogs, spotted salamanders, eastern newts, various dragonflies and damselflies, deer, bobcats, snapping turtles, and a variety of other wildlife.

"I love getting to consistently explore the waters there," said Alyssa Magill, a Beverly High School freshman who has been in the conservation club for four years. "There's a variety of different life within it, and it was fun to go in with nets and see everything that came up. I hadn't experienced anything like that before going to Camp Paradise.

"It's definitely a very different experience getting into the water to see this wildlife for yourself, instead of just hearing about it or seeing pictures."

The camp's wide range of amphibians, invertebrates, and other animals have been documented thanks to the combination of environments on site that have led community members like Jessica Kagle, the director of Kestrel, to push for the property to become a nature learning center.

"The vision is to have a space with a big open classroom that has displays highlighting the special wetland and forest wildlife, and value of the property with the constellation of really sensitive habitats that are here," Kagle said. "I would really like to see routine, accessible public programming several times a week."

The nature learning center proposal would not include any new buildings or structures, due to the conservation restriction on the property. Instead, the proposal focuses on utilizing the existing building for a small office space, a potential space for raising endangered turtle hatchlings, student work displays, and an expansion of the gear-loaning library where visitors could borrow equipment such nets, boots, and local field guides to explore the surrounding wetlands.

With Kestrel already equipped with a staff of expert naturalists who have been focused on teaching wetlands ecology to Beverly for the past 22 years, the proposal aims to incur no cost to the city by utilizing a variety grant fundings and Kestrel's preexisting staff.

Justin Freedman, a parent and direct abutter to Camp Paradise, said that from his own observations the space is underutilized, with the main building often being locked and inaccessible to the public.

"My kids and I love the outdoors and feel lucky to have such a special place to experience nature and have fun outdoors," Freedman said. "Unfortunately, this site is underutilized and often seems neglected. My kids and I frequently clean up trash that is dumped there and the building is always locked and is in need of maintenance.

"The possibility of it being used as a nature learning center at no additional cost to the town seems like an ideal use of the facility for all of the public to enjoy."

Due to the land being protected under Article 97 of state law, the city has thus far been unwilling to consider proposals by Kagle for the creation of the nature learning center, with Mayor Mike Cahill saying the proposal would require a disposition of the land.

Under Article 97 and the terms of the Parkland Acquisitions and Renovations for Communities (PARC) grant awarded by the state for the city to purchase the property, disposition is prohibited without the city first obtaining, among other things, a two-thirds roll call vote of each house of the Legislature, approval from Secretary of EEA, and acquiring or dedicating replacement land.

"The land is protected by Article 97 of the Constitution of the Commonwealth and the priority remains the needs of the city," Cahill said in a statement. "At this time, the city is satisfied with the current programming and is not interested in changing the use of the space. A use of the land that could be interpreted as a lease of the land could be considered a disposition."

In response to this statement, Kagle emphasized that Kestrel is not looking for a transfer of ownership of Camp Paradise or a lease. Instead, the proposal is for a partnership in which the city grants Kestrel a renewable license for up to a year for a purpose consistent with conservation.

"We are proposing a partnership where we work with the city, make some suggestions, listen to their goals, take input from the general public and provide a service," Kagle said. "We're not interested in anything that would challenge the existing protections. Article 97 is not triggered by having a nature center operated by a nonprofit. It is only triggered by changes in use to non-conservation related uses, or changes to structures."

Today, Camp Paradise is used by organizations like Beverly's Girl Scout Troop 4, Kestrel, and the city's Parks and Recreation Department. The Recreation Department runs occasional programs throughout the year, including a class on identifying and foraging local plants last July, a six-week beginner oil painting class on Saturdays during the winter, as well as a "Polar Park" February vacation program for kids with games, arts and crafts, and outdoor recreation.

Kagle said Kestrel would continue to share the property with any other city or local organizations looking to utilize the space for compatible uses. Kagle also indicated they would offer support in the form of naturalist services and equipment loans to enhance the usage of the Girl Scouts, who have a guaranteed right to a certain amount of site usage as part of the original sale documents.

"We envision Kestrel caring for and programming the site, while collaborating to share it with others in the community," Kagle said. "We have no interest in restrictive or exclusive use of Camp Paradise. We envision more, not less, use by the community at large, including groups such as the Scouts."

The issuance of a revocable permit or license of limited duration is not considered to be a disposition of land subject to Article 97, as long as it doesn't transfer any interest in land or authorize a change in how the land is used, According to the state Executive Office of Environmental Affairs.

Kagle cited other nature learning centers in Massachusetts that have been established on Article 97 land, including at Cambridge's Magazine Beach, where in 2021 the state Department of Conservation and Recreation awarded Mass Audubon, a private nonprofit, with a five-year license to the park's historic powder house to transform it into a three-season facility with free drop-in nature programs.

"Beverly is one of the few towns in Essex County that doesn't have a major natural resource center, and I think we're really well positioned to have one," Kagle said. "As the only building on wild public land in Beverly, I think it's important to use the Camp Paradise lodge in a way that is directly related to the precious wild land it is situated upon.

"Wetlands require wildlife corridors, safe crossings between wetlands on migration nights, siltation fences, and a lot of other additional work to actually conserve them — and that can't happen without public awareness."

Re: Amending Beverly Ordinances § 253-24, Objects or items projecting over or placed on public ways and sidewalks; § 261-5, Prohibited acts

Dear Honorable Council:

Enclosed please find a proposed order amending Beverly Ordinances § 253-24, Objects or items projecting over or placed on public ways and sidewalks and § 261-5, Prohibited acts.

The amendments would address vegetation on private premises that interferes with or obstructs public ways and that are not trimmed as required by the existing ordinance. In the event that a private property owner does not remove obstructing vegetation, the amendment would allow the City to enforce the ordinance through a warning and subsequent fines, and bill private property owners for the cost of removal of the obstructing vegetation.

Please initiate action on this matter at your next City Council meeting, Monday, September 21, 2026. Thank you.

Sincerely yours,
