Presentation, Awards and Memorials:
David Michelsen, South Essex Sewerage District (SESD)-A Presentation on Sustaining SESD for the Future Board Chairman Mike Parsons introduced Executive Director Dave Michelsen, General Counsel Kristen Kolick, and Mike Collins, Beverly's representative on the District Board.
Mr. Parsons stated that SESD was facing significant financial challenges that could affect its ability to fulfill its statutory mandate. He explained that SESD was seeking an exemption from the limitations of Proposition 2½ and was presenting the issue to its member communities and state legislative delegation. Mr. Parsons explained that SESD's expenses fall into two principal categories: operating costs and capital improvements.
Mr. Parsons explained that SESD operates as a wholesale wastewater provider, receiving wastewater from member communities, treating it and discharging the treated water into Salem Sound. Beverly's local sewer infrastructure remains the responsibility of the city, while SESD assessments are ultimately reflected in local sewer rates.
The District's total annual assessment had remained relatively level at approximately $25 million for many years because increasing operating costs had been offset by declining debt from a major treatment-plant expansion completed in the 1990s.
Mr. Parsons stated that residuals disposal currently costs approximately $4.5 million annually and that the District's favorable long-term contract was expiring. SESD expected FY2028 residuals-disposal costs to increase by approximately $1.5 million to $2 million annually. He stated that this increase could not be absorbed within the existing Proposition 2½ limit.
SESD also faces significant capital needs because much of its treatment-plant equipment is approximately thirty years old and becoming obsolete. One project of particular importance to Beverly is the single wastewater pipeline extending from Water Street to Salem Willows and the treatment plant. Mr. Parsons stated that the line is approaching the end of its useful life and that failure beneath the harbor would present a serious risk.
SESD had retained consultants to prepare a twenty-year capital-improvement plan. The first group of approximately twenty projects totaled roughly $150 million, while the first ten years of planned improvements, including program management, were projected at approximately $390 million.
The Collins Center at UMass Boston analyzed the projected impact on member communities. Beverly's current SESD assessment is approximately $5.3 million. The initial operating increase for Beverly was projected at approximately $390,000, increasing to approximately $760,000 by FY2032. Capital financing could initially add approximately $165,000, with permanent financing eventually adding approximately $2 million to Beverly's assessment.
Mr. Parsons stated that SESD would continue seeking subsidized financing through programs such as the State Revolving Fund, but substantial grants could not be assumed. SESD proposed increasing its Proposition 2½ operating ceiling from approximately $26 million to $30.5 million, which the District projected could provide approximately five to seven years of operating capacity. SESD also sought debt relief for the approximately $390 million ten-year capital program, an increase in its statutory stabilization-fund cap, and modernization of portions of its enabling legislation dating to 1925.
Mr. Parsons noted that other wastewater authorities and municipal enterprise systems are not subject to the same Proposition 2½ limitations. He warned that without relief, SESD could face difficulty developing an adequate FY2028 budget. Potential reductions could affect maintenance at a time when aging infrastructure requires increased attention, potentially resulting in reduced reliability, permit violations, water-quality impacts, fines or regulatory action.
Rotondo asked Budget Analyst Gerry Perry for his initial assessment. Mr. Perry stated that he had only recently received the relevant information and was not yet in a position to independently verify the financial projections or quantify the full impact on Beverly. He stated that he was not surprised by the cost of the infrastructure needs or by SESD's difficulty operating within Proposition 2½.
However, after reviewing draft legislation, Mr. Perry stated that he was not comfortable with the legislation in its current form and believed additional financial guardrails and regulatory oversight should be included to protect ratepayers. Mr. Perry clarified that he was not suggesting SESD had acted improperly. Rather, he believed the size of the financial authority being requested warranted stronger safeguards.
Based on his prior experience with municipal-finance legislation at the Massachusetts Department of Revenue, Mr. Perry recommended that SESD consult with DOR before submitting the legislation. He also suggested considering an independent peer review of the District's capital and financial assumptions.
President Flowers clarified that the Council was not being asked to vote on a resolution or legislative proposal that evening and would have additional opportunities to review the matter.
Houseman commented that, if the legislation authorizing the SESD is as old as he understands it to be, the current financial concerns also present an opportunity to modernize the District's governing legislation and incorporate stronger financial controls and protections for ratepayers.
President Flowers thanked the SESD representatives and stated that the discussion would continue.
A motion to break for subcommittee work was made and seconded. A vote was taken, and motion carried (8-0). The meeting recessed from 8:38 PM until 9:00 PM when President Flowers called the meeting back to order for Reports of Committees.
Comments by Citizens:
Alyssa Magill, 182 Brimbal Avenue, address the council in support of establishing a nature center at Camp Paradise. She stated that she had participated in Kestrel's Conservation Club for approximately four years. She described Camp Paradise as important wildlife habitat and specifically discussed a vernal pond near a dump area. She expressed concern about runoff, an oily film and possible harm to frogs, tadpoles, salamanders and other wildlife.
She stated that a nature center could provide youth classes, field trips and hands-on environmental education and believed Camp Paradise was a strong location for such a facility.
Diana Neithamer, 12 Pratt Avenue, began with a land acknowledgment and addressed the council to speak regarding the City's use of Flock license plate reader cameras. She thanked the Council for the April 21 joint committee meeting and stated that she had a petition signed by more than one hundred residents asking the City to cancel its contract with Flock.
Ms. Neithamer referenced an audit of Flock data released in response to an April 17 public records request and stated that, in her interpretation, Beverly data had been accessed or shared with out-of-state law-enforcement agencies tens of thousands of times per month. Ms. Nehammer asked the Council to schedule a follow-up meeting or adopt a resolution addressing residents' concerns.
Jessica Kagle, 8 May Street, Director of Kestrel Educational Adventures addressed the council in support of Kestrel's proposal to establish a free public nature center focused on wetlands at Camp Paradise at no cost to the City. Ms. Kegel also raised concerns about the treatment of wetlands on public property, including at Camp Paradise and Bartlett Gardens. She cited salt dumping, frogs and turtles being run over, a compost area located too close to a spotted salamander breeding pond, mowing within a wetland buffer and leaf dumping. She discussed the ecological importance of wetlands and stated that education was necessary to help residents understand and protect them.
Public Hearings:
7:30 PM-Order #119-Proposed Amendments to The Beverly Zoning Ordinance: Accessory Dwelling Unit Ordinance. President Flowers opened the hearing at 7:30 PM. President Flowers explained that the hearing had originally been intended to be a joint public hearing with the Beverly Planning Board, the agenda had not been posted to reflect a joint hearing. In an abundance of caution under the Open Meeting Law, the City Council would conduct its portion of the public hearing that evening and the Planning Board would conduct a separate hearing.
Planning Director Darlene Wynne introduced Assistant Planning Director Ken Clawson and explained that Beverly had adopted a local Accessory Dwelling Unit (ADU) ordinance before the Commonwealth subsequently enacted statewide requirements. Portions of the local ordinance therefore needed to be amended to align with state law.
Mr. Clawson explained that Beverly's ordinance, adopted in December 2023, allowed attached and detached ADUs by right in most single-family residential districts, removed family-member restrictions, required owner occupancy, required one off-street parking space and established dimensional requirements.
The subsequent state law requires ADUs by right in zoning districts that allow single-family homes and prohibits certain local restrictions. Mr. Clawson explained that the principal changes include removal of Beverly's owner-occupancy requirement, prohibition of parking requirements for ADUs located within one-half mile of a transit stop, and allowing otherwise compliant ADUs to proceed through the building-permit process without additional zoning relief merely because another portion of the property is nonconforming.
Houseman asked Mr. Clawson to identify the most significant differences between Beverly's existing ordinance and the state requirements. Mr. Clawson reiterated the owner-occupancy and parking requirements and nonconformity changes. He also explained that the state's protected-use standard establishes a maximum ADU size of 900 square feet, while Beverly allows up to 1,000 square feet or one-half the gross floor area of the principal dwelling, whichever is smaller. He confirmed that Beverly's provision is not more restrictive.
No members of the public were in attendance to speak on the order.
President Flowers closed the public hearing at 7:38 PM and referred the order to the Committee on Legal Affairs.
A motion was made and seconded to take the agenda out of order to hear public comments. A vote was taken, and motion carried (8-0).
7:50 PM-Order #129-National Grid Petition # 31302639 to install underground facilities on Chase St/West Dane St. President Flowers opened the hearing at 7:50 PM. A National Grid representative, Sibhita Mahabier-Sheehy, explained that the petition should more accurately be described as an upgrade to an existing underground service location rather than a new installation.
Councilor Spang asked how long the work was expected to take. The representative estimated no more than approximately four hours. She further explained that two existing conduits would be replaced with upgraded conduits. Limited street excavation would be required.
No members of the public were in attendance to speak on the order.
President Flowers closed the public hearing at 7:52 PM and referred the order to the Committee on Public Services.
8:00 PM-Order #124-A request for an interdepartmental transfer of $190,000 to support the required shift coverage costs for the Fire Department during FY2026. President Flowers opened the hearing at 8:00 PM. Finance Director Bryant Ayles explained that unexpected staffing circumstances resulted in greater overtime use than originally budgeted. The Administration identified six areas elsewhere in the City budget that were underspending and proposed reallocating those already-appropriate funds to the Fire Department. Mr. Ayles emphasized that the request did not involve additional funding beyond what had already been appropriated.
Sonia expressed concern regarding future budgeting rather than the immediate transfer, noting that similar reallocations had been required in prior years. Mr. Ayles explained that the Fire Department had often been able to address overtime overages through internal departmental transfers. FY2026 was tighter, however, and the Department did not have sufficient savings to absorb the full amount. He stated that the overtime line would need to be adjusted upward in FY2027.
Fire Chief Peter O'Connor described FY2026 as an unusual year, with more than twelve firefighters out for extended periods due to injuries, as well as two firefighters who left in August for the Chelsea Fire Department. He explained that the Department normally staffs approximately sixteen personnel per shift but must maintain at least thirteen on duty to appropriately staff apparatuses. When staffing falls below thirteen, overtime must be used. At the minimum staffing level, the Department operates one engine in three areas of the city and one ladder for the entire City. He stated that injuries, employee departures, vacations, and regular leave combined to increase overtime use throughout FY2026.
Houseman asked Budget Analyst Gerry Perry to supplement his written recommendation. Mr. Perry noted that he recommended approval of the transfer and stated that he had confirmed the funds were available. He provided historical context, noting transfers of approximately $58,250 in May 2024, approximately $140,000 several years earlier, and a $235,000 transfer in 2019 from Police Dispatch for fire alarm expenses.
Mr. Perry stated that his principal concern was FY2027. Approximately $810,000 was needed for Fire Department overtime in FY2026, and salary increases under the collective bargaining agreement would also increase future overtime costs. He also noted that approximately $160,000 had been transferred to Dispatch during FY2026, bringing transfers into Public Safety during the fiscal year to approximately $350,000. Mr. Perry encouraged the Council to closely review public safety appropriations during the upcoming FY2027 budget hearings.

Public Services:
Order #50-GONETSPEED-A petition to install and maintain underground facilities-Friend Street. The Committee on Public Services recommended that the petition to install and maintain underground facilities on Friend Street be granted subject to the following eleven conditions:
- CRC Communications, LLC d/b/a " GoNetspeed" ("GoNetspeed" shall mean and include GoNetspeed and its contractors, subcontractors, or any other person or entity working on its behalf or at its direction) shall comply with all applicable City of Beverly Ordinances, rules, and regulations.
- GoNetspeed shall comply with the "Dig Safe Law," Chapter 82, Sections 40 through and including 40E of the Massachusetts General Laws and the Department of Public Utilities regulations issued thereunder.
- GoNetspeed shall comply with the "Excavation and Trench Safety Law," Chapter 82A of the Massachusetts General Laws.
- GoNetspeed shall comply with all orders or decisions issued by the City of any City official pursuant to any City Ordinance, rule, or regulation, any Massachusetts statute or regulation, or any other legal authority authorizing said City official to issue an order, including an order to GoNetspeed directing a halt to the work.
- GoNetspeed shall excavate test pits along the proposed project to identify soil profiles and bedrock depth prior to any drilling or trenching.
- GoNetspeed shall undertake all commercially reasonable efforts to use directional boring to install the proposed conduits. Should GoNetspeed intend to trench instead, GoNetspeed shall notify the Commissioner of Public Services & Engineering and City Engineer of the good faith efforts it took, and the Commissioner may waive the need to directional bore upon an adequate showing by GoNetspeed of an undue practical hardship or other showing of lack of feasibility.
- GoNetspeed shall repave any impacted street from curb-to-curb to the City's Engineering Department standards.
- GoNetspeed shall reconstruct any impacted sidewalk in full and with materials in kind to the City's Engineering Department standards.
- GoNetspeed shall re-loam and re-seed any impacted grassy areas to the City's Engineering Department standards.
- In the event GoNetspeed removes or damages public shade trees it shall replace those trees in consultation with the City Arborist. In the event GoNetspeed removes a tree or bush on private property, it shall replace those trees or bushes in consultation with the property owner.
- GoNetspeed shall guarantee the continuing health of any newly planted replacement tree and those subject to root cutting related to the work, for a period of two (2) years from the date of planting. Should impacted trees die or become substantially impaired during this two-year period, as determined by the City Arborist, GoNetspeed shall replace any impacted tree. This requirement shall be limited to a one-time replacement.
Spang thanked City Engineer Lisa Chandler, Project Manager Sean Ciancarelli, and City Solicitor Oldmixon for their assistance in developing the conditions related to the National Grid petition. She also thanked Mayor Cahill, Commissioner Collins, and Ms. Chandler for participating in site visits with GONETSPEED and assisting with the draft conditions for the petition.
Rotondo stated that he remained supportive of increased competition and providing ratepayers with additional choices but continued to have concerns with the process. He noted that utility poles were being replaced in areas including Ashton Street and County Way and questioned how that work related to the need for underground conduit. He also expressed concern regarding accountability as GONETSPEED establishes its relationship with the City and stated that, while the current work is limited in scope, the service is ultimately expected to expand citywide. Rotondo reiterated that his concern was not with GONETSPEED moving forward, but with how the process had been rolled out.
Feldman echoed some of Rotondo's concerns and questioned whether a two-step permitting process could be considered for similar projects. She suggested an initial exploratory approval that would allow a provider to conduct necessary site research and gather information before seeking a full permit, allowing the Council to consider the request with more complete information.
Houseman thanked City staff for their work throughout the process. He noted that residents had expressed interest in increased competition and stated that GONETSPEED representatives had been responsive to questions and communications. He acknowledged that coordination with existing utilities and issues involving double poles made the permitting process difficult for new providers. Houseman suggested that the city may need to consider ways to improve coordination with existing utilities and requested notice when the approved work is scheduled so he could observe the process on site. He stated that the limited work moving forward would provide an opportunity to see how the process works on the ground.
President Flowers put the question of acceptance of the proposal and adoption of the order as recommended by the subcommittee. A motion was made and seconded. A vote was taken, and the motion carried (7-1 with Rotondo in opposition).
Order #129-National Grid Petition # 31302639 to install underground facilities on Chase St/West Dane St. President Flowers put the question of acceptance of the proposal and adoption of the order as recommended by the subcommittee. A motion was made and seconded. A vote was taken, and the motion carried (8-0).
President Flowers noted the Human Rights Committee's difficulty maintaining full membership and filling vacancies. To waive the required 72-hour waiting period and permit Mr. Bulbil to be sworn in sooner, President Flowers moved to reconsider Order #112 with the intention that the motion to reconsider fail. The motion was seconded. A vote was taken, and motion failed (0-8 with all members present in opposition).
President Flowers noted that it was Municipal Clerks Week. President Flowers recognized Clerk Kent, Assistant City Clerk Kirker and the City Clerk's Office for their constituent service, support of the City Council and administration of elections. President Flowers also recognized Teacher Appreciation Week and thanked educators throughout Beverly, including the Council member who works as an educator.
Feldman announced that the next Varian public update meeting will be held Tuesday, May 12 at 7:00 PM at Beverly Middle School, with doors opening at 6:30 PM.
Rotondo announced that the first in a series of neighborhood meetings concerning upcoming changes to the City's trash and recycling program would be held at Ryal Side Elementary School on Wednesday from 6:30 PM to 8:00 PM.
Spang noted that residents could also attend the corresponding meeting at City Hall on Thursday evening. Feldman asked whether the City Hall meeting would be available through BevCam. It was confirmed that it would be.
President Flowers clarified that the Administration planned to hold a meeting in each ward, with the Mayor and his team providing the presentation and ward and at-large Councilors participating to discuss upcoming changes to trash and recycling program.
A motion to adjourn was made and seconded. A vote was taken, and motion carried (8-0). The meeting adjourned at 9:21 PM.

Order #133-Councilor Houseman noted that he worked on and sponsored and advocated for two of the grants and would recuse himself from the vote on those when the time comes
Order #136-Housman noted that the recommendation is in line with other positions in the city and well deserved. Chair Feldman noted that is a request to increase the City Clerk's salary for the upcoming fiscal year, and it's a 3% increase, and that's in line with other cost of living adjustment as well as other department heads t and appropriate for the amount of work and longevity we've had here in the city
President Flowers thanked Finance Director Bryant Ayles, noting that she had worked with him to ensure the recommendation was consistent with those of other department heads while remaining fiscally responsible in light of the anticipated FY2027 budget challenges.
Housman further noted that, in his experience with various City Clerks, Ms. Kent had been easy to work with, organized, and extremely responsive to the Council and its needs.
Order #134-Finance Directory Bryant Ayles noted that budgeting requires a balance given the uncertainty of actual activity and expenses. While appropriations should be sufficient to meet anticipated needs, overbudgeting in one area could unnecessarily set aside taxpayer resources at the expense of other funding priorities. The goal is therefore to budget as accurately as possible while recognizing that actual costs cannot always be predicted.
Budget Analyst Gerry Perry stated that transfers of this nature are a normal part of the budgeting process, as it is difficult to predict departmental needs a year in advance, agreeing that unexpected injuries and staffing circumstances cannot be anticipated when developing the budget. Mr. Perry reiterated, however, that the current Fire Department overtime appropriation of approximately $630,000 would not be sufficient for FY2027. While he did not believe the City could budget the approximately $810,000 needed in FY2026, he stated that the overtime appropriation would need to increase into the $700,000 range.
A motion to adjourn the Committee on Finance and Property was made and seconded. A vote was taken, and motion carried (3-0). The meeting adjourned at 8:53 PM.

Erin Altman, 6 Iverson Road, addressed the Council to speak in support of the proposed trash fee, citing the rising cost of trash collection, the City's financial challenges, and the need to support schools and long-term financial stability.
Public Hearings:
7:45 PM-Order #133-Community Preservation Committee-Thirteenth Round CPA Project Funding Recommendations. President Flowers opened the hearing at 7:45 PM. Committee Chair Derek Beckwith reported that the (Community Preservation Committee) CPC received eight applications totaling $1.8+ million: three recreation projects, two community housing projects and three historic resource projects. After review of the applications the CPC recommends funding for the eight projects totaling $1,795,866 from CPA funds.
Mr. Beckwith noted that the eight applications originally represented requests exceeding the funding available within the applicable CPA categories. He explained that although the overall CPA balance of $2,938,525.98 available for funding, however it only available by category. He noted that there were no projects in the open space category, therefore the $529,998.58 restricted to that category could not be used for the projects before the Council. The applications therefore initially exceeded available usable funds by approximately $289,000. Mr. Beckwith stated that the Committee worked with applicants to identify possible reductions.
Mr. Beckwith specifically recognized the Beverly Housing Authority and proponents of the Central Cemetery projects for revising their proposals. The Beverly Housing Authority reduced its Garden City Towers request by approximately $477,884 after accelerating design and engineering review. The Central Cemetery proposals were also restructured and phased to reduce the immediate funding request. As a result, $612,661 would be available for future eligible projects.
The recommended projects were:
Recreation Projects
- Gillis Park Basketball Court Replacement ($130,155)-The project would replace and resurface the basketball courts, including new markings, benches, poles, backboards and hoops, and would meet ADA standards. Mr. Beckwith noted the park is located in Ward 2 Goat Hill neighborhood within an environmental justice population area.
- Ahearn Park/Goldway Playground Renovation ($250,000)-The project includes basketball court rehabilitation, playground equipment, benches and an ADA-compliant spinner to support inclusive play. The project is also located in Ward 2 downtown neighborhood within an environmental justice population area.
- Gilbert Park/Bartlett Gardens Playground Renovation ($240,000)-The project includes basketball court and playground improvements intended to renovate and rejuvenate the park.
Community Housing Projects
- Garden City Towers Fire Protection Sprinkler Installation ($825,645)-The Beverly Housing Authority project would install a comprehensive fire suppression and detection system at Garden City Towers. Mr. Beckwith discussed the particular fire-safety concerns associated with the seven-story building and its older resident population and referenced correspondence from the Beverly Fire Chief identifying the property as a target hazard. He noted that the Housing Authority substantially reduced its original request after additional design and engineering work.
- Affordable Housing Trust ($64,004)-Funding would support community housing projects meeting CPA eligibility requirements. Mr. Beckwith noted this amount is half of what the state mandates the city to spend on affordable housing through CPA Funds. Mr. Beckwith noted that similar prior funding had been combined with Affordable Housing Trust funds to extend affordability restrictions at Turtle Creek for 67 units for an additional 30 years.
Historic Resource Projects
Houseman recused himself from consideration of the 2 historic cemetery preservation projects. - Central Cemetery Tomb House Study and Preliminary Work ($23,390)-Funding would support the first phase of work necessary to evaluate and design restoration of the historic Tomb House, constructed in 1891. Mr. Beckwith stated that the structure is in significant disrepair and has been temporarily stabilized by the City. - Central Cemetery Fence and Gates ($237,000)-The first phase would address fencing along a highly visible portion of the cemetery that is in significant disrepair. - The Garden School Historic Long House Roof Replacement ($25,672)-The project would replace the failing roof of the historic Long House. Mr. Beckwith explained that the property has been determined historically significant and that the work would be subject to appropriate historic preservation standards and protections for the City's investment.
Crowley asked whether the reduced Garden City Towers project remained sufficient to address the Fire Department's safety concerns. Mr. Beckwith stated that the project remained in the design phase and that the Fire Department would continue to be involved in the process.
No members of the public were in attendance to speak on the order. President Flowers closed the public hearing at 8:15 PM and referred the order to the Committee on Finance and Property.
A motion to recess for subcommittee work was made and seconded. A vote was taken, and motion carried (8-0).
The meeting recessed from 8:15 PM until 8:37 PM when President Flowers called the meeting back to order for Reports of Committees.

President Flowers put the question of acceptance of the proposal and adoption of the order as amended by the subcommittee from $425 to $300 and from $280 to $210.
St. Hilaire reiterated concerns regarding the pace of the process and stated that he did not believe the Council should vote before hearing additional public input and reviewing the proposed FY27 budget.
Mayor Cahill stated that the Financial Forecasting Committee had identified trash fees as an area requiring review and likely significant increases. He explained that the process of evaluating the City's trash and recycling system began during the 2025 trash strike and continued through discussions with regional haulers, industry research, consultation with the Waste Reduction Committee, and a public request for expressions of interest.
Five haulers met with the City and three submitted responses. Two proposed only automated collection and one provided pricing for both automated collection and continuation of the existing collection model. Mayor Cahill stated that continuing non-automated collection was substantially more expensive, in part because traditional collection requires three-person crews while automated trucks require one operator.
The current program cost was identified at approximately $3.9 million, compared with approximately $5.46 million under the new automated program. The cost to remain non-automated was approximately $7.8 million. The City ultimately selected Casella following final negotiations with Casella and Republic. Mayor Cahill stated that the proposals were financially close, but Casella offered advantages including lower one-time cart costs and service considerations.
The new program will include automated trash and recycling collection. Bulk items and white goods will require advance scheduling and payment under a negotiated price schedule. Yard waste collection will continue, although spring curbside collection will be reduced from six weeks to three weeks, with fall collection scheduled later in the season. Overflow bags will no longer be available under the automated system. Existing hardship and senior discount provisions based upon income eligibility were noted.
Mayor Cahill discussed waste-diversion efforts, including the Black Earth composting program, textile recycling, continued yard waste disposal at Stanley Street, and plans to establish a CHaRM (Center for Hard to Recycle Materials) facility at Stanley Street for hard-to-recycle materials. The facility would initially focus on materials with established disposal or recycling markets, including cardboard and textiles, with a goal of expanding to materials such as scrap metal, polystyrene, batteries and light bulbs.
Mayor Cahill acknowledged concerns regarding the proposed trash fee increase and the attention directed toward the City Hall renovation project. He noted that the Council approved the project earlier this year and reaffirmed its necessity, citing significant deficiencies in ADA accessibility, bathrooms, workspaces, HVAC systems, insulation, and outdated infrastructure. He further noted that the project would allow the Health, Building, and Retirement Departments to return to City Hall, providing additional space at the Senior Center.
Mayor Cahill addressed the City's debt service, noting its decrease from approximately 8–9% to 5% of the operating budget. He reviewed the City's history of capital improvements, including school projects and the police station, with elementary school roof and HVAC replacements anticipated in the next five to ten years. He emphasized the importance of maintaining funding for capital improvements rather than redirecting it toward recurring operating expenses, which could jeopardize future projects or require debt exclusions.
Rotondo asked about every-other-week recycling and whether the savings associated with that option could be reconsidered. Mayor Cahill stated that the option had been evaluated but the administration did not believe reducing recycling frequency was the appropriate policy while simultaneously asking residents to reduce trash. He noted the savings would have been approximately $400,000-$500,000 annually and agreed to continue considering the question and potential consequences.
Rotondo also suggested establishing a regular review of the trash fee so that future Councils would not face another substantial increase after a long period without adjustment. Mayor Cahill stated that he was open to a regular review and acknowledged that periodic increases over the previous twenty years would have made the present increase less abrupt.
Feldman asked whether the ordinance could be structured around a percentage of program costs rather than a fixed fee and asked whether traditional pay-as-you-throw had been considered. Mayor Cahill explained that the automated system requires materials to be placed within carts, although the different cart sizes function in some respects as a modified pay-as-you-throw system because residents selecting a smaller cart would pay a lower fee.
The administration also discussed allowing residents to opt up to a 95-gallon trash cart for a higher annual fee. Mayor Cahill stated that this could assist households that regularly generate more waste, while retaining the incentive for households able to use smaller carts.
Solicitor Oldmixon, in reference to Councilor Feldman's question on the ordinance fee structure, noted that under Massachusetts case law that one legislative body cannot bind a future legislative body for a specific appropriation.
St. Hilaire addressed the Mayor's comments regarding the financial forecast, communication with the Council, and City Hall renovation project. He noted that the December Financial Forecasting Committee report identified several potential revenue enhancements and cost-saving measures but did not specifically recommend a $425 trash fee. He expressed frustration with the limited communication regarding the proposed increase and Casella contract. He reiterated his opposition to the increase and urged reconsideration of the City's spending priorities, including staffing, operating expenses, and the City Hall renovation project, before imposing additional costs on residents.
Feldman acknowledged the difficult timing and financial impact of the proposed increase but emphasized the distinction between capital and operating expenses, stating that debt allocated for capital projects should not be used to address recurring operating deficits. She noted that rising costs have outpaced municipal revenues and that the City's financial challenges would require both additional revenue and expenditure reductions. She referenced the approximately $4 million projected deficit, expected to grow to $7 million within two years, and stressed that a one-time fee increase would not resolve the City's long-term financial challenges without structural budget reductions.
St. Hilaire disagreed with Councilor Feldman's characterization of his position and reiterated that the City's debt service allocation could be reconsidered to offset the proposed trash fee increase. He referenced approximately $2 million in anticipated debt payments associated with the City Hall project and again urged the Council to reevaluate spending priorities, including staffing, health insurance, and other operating expenses, before imposing additional costs on residents.
Mullady acknowledged the difficult financial circumstances facing Beverly and surrounding communities. He recognized that the existing trash fee structure is unsustainable while also acknowledging that the proposed increase would be unaffordable for many residents. He encouraged continued discussion and compromise to minimize the financial burden while addressing the City's budgetary challenges.
Houseman emphasized the importance of maintaining respectful policy discussions despite differing opinions. He questioned whether the Council had authority to amend the Casella contract. Solicitor Oldmixon stated that there was no language in the contract to allow the Council to amend the contract. Mayor Cahil clarified that negotiating and executing the contract falls under the executive branch's authority and that the Council's responsibility is to determine the proposed fee structure.
Mayor Cahill further discussed the City's financial challenges, noting that approximately $4.5 million of the anticipated $5.8 million in new revenue was proposed for the schools, with the remaining funding needed to address pension, healthcare, and other municipal costs. He noted that positions had already been eliminated from the proposed budget and that the administration was exploring additional revenue through discussions with Endicott College and other nonprofit organizations regarding voluntary contributions.
Houseman emphasized the importance of maintaining the City's debt service allocation to support future capital improvements, including school roof and HVAC replacements. He noted that discontinuing the City Hall project would not resolve the City's recurring operating deficit and could jeopardize future infrastructure funding.
Sonia acknowledged the financial challenges facing municipalities throughout the region and expressed concern with the timing and communication of information provided to Councilors. He emphasized the importance of allowing Councilors sufficient time to review proposals and respond to constituents. He questioned what reductions would be necessary if the Council adopted the lower fee structure. Mayor Cahill explained that the proposed budget assumes adoption of the administration's proposed fees could require additional staffing reductions, decreased departmental or school funding, or reductions to roads and sidewalks.
Sonia questioned whether potential school funding reductions had been discussed with the Superintendent. Mayor Cahill stated those discussions would be necessary if the Council supported a lower fee. Sonia also encouraged improved communication and transparency throughout the process. Mayor Cahill noted that public meetings were scheduled once the proposed figures were finalized and that additional outreach would continue.
Spang stated that she had heard significant concern from residents regarding affordability and did not feel prepared to vote without understanding the specific trade-offs associated with reducing the proposed fee. She also raised concerns regarding households with medical needs that may generate additional waste and stated that an option for a larger cart could be helpful.
Mayor Cahill explained that the proposed cart system would allow residents to select different sizes and suggested adding an option for a 95-gallon trash cart, with a fee adjustment comparable to the reduction offered for a 35-gallon cart.
St. Hilaire reiterated his concerns regarding the City's spending priorities, noting that the FY2027 budget would include debt service for City Hall while roads and sidewalks continued to rely on one-time funding. He requested that the proposed budget be made available before Councilors voted on the trash fee increase. Mayor Cahill stated that the proposed FY2027 budget would be submitted on June 1, in accordance with the City Charter and ordinances.
Rotondo questioned whether the administration would reconsider biweekly recycling collection, noting potential annual savings of $400,000 to $500,000. Mayor Cahill acknowledged the potential savings but expressed concerns regarding recycling capacity, resident participation, and unintended consequences. He agreed to review the option further.
Budget Analyst Jerry Perry reviewed the financial implications of the proposed increase, noting that the FY2027 Casella contract totals approximately $5.4 million, representing a 38% increase. He explained that rising collection and disposal costs have placed similar pressures on municipalities throughout the Commonwealth, with Proposition 2½ revenue limitations unable to keep pace. He referenced the anticipated FY2027 deficit of approximately $3.9 million and emphasized the importance of establishing anticipated revenues before finalizing the budget. Mr. Perry stated that he was not recommending a particular fee amount, as that determination rests with the Mayor and Council, but strongly encouraged a decision before the June 1 budget submission. He cautioned that reducing the proposed fees by approximately $1.4 million could require additional staffing reductions and service cuts.
Mr. Perry also addressed the City Hall renovation project, recalling the Council's approval of an initial $1.5 million transfer in March 2022 and noting that approximately $3.5 million had already been spent. He expressed concern that discontinuing the project or further reducing debt service, currently approximately 5% of the operating budget, could jeopardize future capital improvements, including school roof and HVAC replacements. He recommended maintaining a debt service allocation closer to 7% to support infrastructure needs.
Spang reiterated her desire to understand the specific service and budgetary impacts of a reduced fee before voting.
St. Hilaire responded to Mr. Perry's comments regarding City Hall, noting that financial circumstances had changed significantly since the Council's initial authorization in 2022. He maintained that reconsidering the project remained an appropriate option and requested clarification from the City Solicitor regarding the process for discontinuing it.
Solicitor Oldmixon stated that she could not provide an immediate determination regarding the process for reversing the City Hall project authorization but would review the matter upon request. President Flowers noted that the Council's reconsideration rules would not apply to the earlier vote as it is a 72 hour maximum, and indicated that a written request would be submitted to the Solicitor's Office on behalf of the Council.
Rotondo encouraged the Council to take an initial vote on the amended fee structure to provide the administration with direction and an opportunity to identify potential budget reductions before the next meeting.
Mullady expressed a preference to delay voting until Councilors had additional time to review the financial implications and constituent feedback. He also questioned the prioritization of the City Hall project over anticipated elementary school infrastructure improvements.
President Flowers explained that the proposed ordinance amendment would require two readings and two votes and discussed the possibility of scheduling additional meetings to allow further consideration before the budget submission. Mayor Cahill reiterated that redirecting capital funding toward recurring operating expenses could undermine the City's ability to finance future infrastructure projects without debt exclusions.

Mayor Cahill reiterated that redirecting capital funding toward recurring operating expenses could undermine the City's ability to finance future infrastructure projects without debt exclusions.
Feldman expressed concern about voting on additional revenue before reviewing the proposed FY2027 budget and accompanying expenditure reductions. She emphasized the importance of evaluating the City's financial needs together rather than considering the fee increase independently.
St. Hilaire reiterated his opposition to any trash fee increase and recommended rejecting the proposal and directing the administration to identify additional budget reductions. He suggested reconsidering the City Hall project, staffing levels, consulting and travel expenses, and discretionary management salary increases.
St. Hilaire reiterated his opposition to any trash fee increase and recommended rejecting the proposal and directing the administration to identify additional budget reductions. He suggested reconsidering the City Hall project, staffing levels, consulting and travel expenses, and discretionary management salary increases.
Houseman addressed concerns regarding the prioritization of City Hall over school infrastructure, explaining that maintaining debt capacity would support future school projects as existing facilities reach the end of their useful lives. Mullady clarified that his concern was with the order in which capital projects had been prioritized.
Solicitor Oldmixon reminded the Council that an ordinance amendment requires newspaper publication and that a final vote could not occur until the required ten-day period had elapsed.
President Flowers acknowledged Councilors' requests for additional information and public input and recommended continuing the matter to a special meeting. Rotondo agreed to withdraw his motion of the amended fee proposal of $300 and $210, for consideration this evening. President Flowers announced that the order has been reported out of the Legal Affairs Committee and will remained under unfinished business for further consideration.
President Flowers announced that a Special City Council meeting would be held on Tuesday, May 26, at 6:30 PM, with the proposed trash fee structure as the sole agenda item and an opportunity for public comment.
Crowley requested additional financial information comparing the administration's proposed $425 fee with alternatives of $300 and $200, including the resulting revenue shortfalls and potential budget impacts. Councilor St. Hilaire requested consideration of a scenario with no fee increase. Mayor Cahill stated that the $300/$210 structure was estimated to create an approximately $1.4 million revenue shortfall compared with the administration's proposal, while a $200 standard fee could leave approximately $2.8-$3 million to be addressed elsewhere. No increase would require approximately $4 million to be identified through other revenues or reductions.
President Flowers reminded the Council and public that the next regular City Council meeting would be held on Monday, June 1, including a public hearing on the proposed transfer from certified free cash for the purchase of trash carts. The Mayor's proposed FY2027 budget would also be formally submitted at that meeting, followed by a series of Finance and Property Committee meetings to review the budget.
Spang announced that an opening ceremony for the Knot public art project, a nautical knot-tying exhibit at the waterfront, would be held the following evening, May 19th, at 6:00 PM. She also announced a downtown litter cleanup on Saturday, May 23rd, at 10:00 AM.
Sonia announced upcoming elementary school walk audits being conducted through the Beverly Bicycle and Pedestrian Advisory Committee. Walk audits were scheduled at Cove School on May 22nd, Centerville on May 26th, North Beverly on June 3rd, and Ayers Ryal Side on June 5th, from 2:30-4:30 PM.
A motion to adjourn was made and seconded. A vote was taken, and motion carried (9-0). The meeting adjourned at 10:46 PM.

Rotondo called Committee of the Whole to order at 8:21 PM with Mulldy, Sonia, and Spang present.
Order #142-St. Hilaire expressed his opposition to the proposed trash fee increase, citing concerns with the rushed timeline, lack of transparency, and limited opportunity for public input. He emphasized the financial burden on residents already facing rising costs and questioned whether sufficient efforts had been made to identify reductions within the City's budget. He stated that he could not support the increase without a more thorough examination of the budget and recommended that the administration return with an alternative proposal.
Crowley expressed concerns regarding the financial impact on residents, particularly low-income families, seniors, and those living on fixed incomes. He noted that many Ward 3 residents live in income-based housing and environmental justice communities, where the increased annual fee would present a significant hardship. While acknowledging the City's financial challenges, he suggested exploring a phased-in increase, exemptions or relief for vulnerable residents, and additional cost-saving measures. He stated that he could not support the proposal as presented but favored moving it out of committee for further discussion.
Rotondo acknowledged the concerns raised and noted that the City's December 2025 financial forecast had identified a potential trash fee increase, attrition, and layoffs as possible measures to address budget challenges. He stated that without an increase, the City could face approximately 54 layoffs. While recognizing the need for further budget review, he supported considering a reduced or phased-in increase and moving the matter to the Committee of the Whole for additional discussion and public input.
Rotondo made a motion to amend the proposed fee amounts from $425 and $280 to $300 and $210, respectively. The motion was seconded. A vote was taken, and the motion carried (2–1 with St. Hilaire in opposition).
A motion to adjourn the Committee of the Whole was made and seconded. A vote was taken, and motion carried (3-0). Committee of the Whole adjourned at 8:30 PM.
A motion to adjourn the Committee on Legal Affairs was made and seconded. A vote was taken, and motion carried (3-0). The meeting adjourned at 8:30 PM.

The Honorable City Council Beverly City Hall Beverly, MA 01915
RE: Orders 2026-#223A and 223B – Taking of Easements in and Acceptance of Millbrook as a Public Way
Dear Honorable City Council:
Attached hereto are two proposed Orders which will complete the process necessary for the acceptance of portions of Millbrook Road as public ways. Millbrook Road is an accepted public way until approximately Hickory Lane, and is a private way beginning at 9 and 12 Millbrook Road. These Orders will allow the City to complete the layout and acceptance process for the remaining portion of Millbrook Road. As required by law, Order 2026-#223 referred the layout plan to the Planning Board for its review. On October 6, 2026, the Board reported its vote to recommend acceptance of those portions of Millbrook Road as public ways.
The first of the two Orders is the taking by eminent domain of easements over the roadway (Order 2026-#223A). Each of the owners of those portions of roadway have agreed to donate permanent easements to the City in the private ways abutting the front of their properties and have waived the paying of any compensation for these taking. The second of the two Orders is the adoption of the layout and the acceptance of public ways over those portions of Millbrook Road (Order 2026-#223B).
Thank you for your attention to this matter.
Sincerely yours,
Michael P. Cahill Mayor

Council, does hereby adjudge that public safety, necessity, and convenience require the taking by eminent domain for public way purposes the permanent easements shown on a plan entitled "Easement Plan of Land in Beverly, MA," dated August 13, 2025, and revised September 16, 2026, prepared by Hancock Associates, which plan is included as part of this Order and attached hereto as Exhibit 1. Each individual permanent easement is particularly described by its address, area, location, and its corresponding book and page number and/or land court document number in the list which list is included as part of this Order and attached hereto as Exhibit 2, prepared by the City of Beverly Department of Engineering.
The permanent easements identified in Exhibits 1 and 2 are for all purposes related to those which public ways are used in the City of Beverly, including passage by foot, vehicle, and/or heavy equipment; surveying, grading, constructing, building, repairing and maintaining the roadways, sidewalks, driveways, and public utilities and infrastructure; and the right to enter upon such easement premises at any time to inspect, survey, grade, construct, build, repair, replace, improve, and maintain the roadway, sidewalk, driveway, and public utilities and infrastructure, including entry by foot, vehicle, and/or heavy equipment and for parking and storage.

(i) the dealer's default or nonpayment of valid bank drafts, including checks drawn by the dealer for the purchase of a motor vehicle; (ii) the dealer's failure to deliver, in conjunction with the sale of a motor vehicle, valid title certificate free and clear of any prior owner's interests and all liens except a lien created by or expressly assumed by the buyer of the vehicle; (iii) the fact that the motor vehicle was a stolen vehicle; (iv) the dealer's failure to disclose the vehicle's actual mileage at the time of sale; (v) the dealer's unfair and deceptive acts or practices, misrepresentations, failure to disclose material facts or failure to honor a warranty or arbitration order in a retail transaction; or (vi) the dealer's failure to pay off a lien on a vehicle when the dealer had assumed the obligation to pay off the lien in the sale of the vehicle.
(2) Recovery against the bond or its equivalent may be made by any person who obtains a final judgment in a court of competent jurisdiction against the dealer for an act or omission against the bond on which the bond is conditioned if the act or omission occurred during the term of the bond. Every bond shall also provide that no suit may be brought to enforce any liability on the bond unless brought within 1 year after the event giving rise to the cause of action.
(3) A separate bond or its equivalent shall cover only those acts and omissions described in clauses (i) to (vi), inclusive, of paragraph (1). The surety on a bond shall not be liable for total claims in excess of the bond amount, regardless of the number of claims made against the dealer during the term of the bond.
(4) In lieu of the bond required by this section, the municipal licensing authority may allow the dealer to deposit collateral in the form of a certificate of deposit or irrevocable letter of credit, authorized by any banking laws of the commonwealth, which has a face value equal to the amount of the bond otherwise required. The collateral may be deposited with or substituted for, by the commonwealth, interest on the certificate of deposit shall be payable to the dealer who has deposited it as collateral, or to a person at the dealer or the bonding authority direct.
(5) A surety shall provide to the municipal licensing authority notice of cancellation of the bond within 30 days of the cancellation. Upon receipt of notification from a surety that a bond has been cancelled, the municipal licensing authority shall notify the licensee that he has 10 days to comply with the bond requirement. If the licensee does not comply with this 10 day period, the municipal licensing authority shall revoke the Class 2 license and shall notify the licensee who shall surrender any dealer plate issued to the licensee pursuant to section 5 of chapter 90.
(6) A municipal licensing authority shall not issue or renew a Class 2 license unless it is satisfied that a bond or equivalent proof of financial responsibility meeting the requirements of this section is in effect during the term for which the license shall be issued or renewed, and that the dealer maintains or demonstrates access to repair facilities sufficient to enable him to satisfy the warranty repair obligations imposed by said section 7N1/4 of chapter 90. A used car dealer shall remain liable for all warranty repairs and other obligations imposed by said chapter 90.
(d) Class 3. A dealer whose principal business is the buying of second hand motor vehicles or parts thereof for the purpose of resale of parts of second hand motor vehicles may be granted a motor vehicle junk license. The registrar shall adopt rules and regulations defining sufficient repair facilities for the purposes of subsection (b) and paragraph (4) of subsection (c).
Section 59. Licensing authorities; expiration; fees; application; prerequisites; premises; ordinance regulations; revocation.
The police commissioner in Boston and the licensing authorities in other cities and towns may grant licenses under this section which shall expire on January first following the date of issue unless sooner revoked. The fee for the license shall be fixed by the licensing board or officer, but in no event shall any such fee be greater than $200. Application for licenses shall be made in such form as shall be approved by the registrar of motor vehicles, in sections fifty-nine to sixty-nine, inclusive, called the registrar, and if the applicant has not held a license in the year prior to such application, such application, with a duplicate thereof, shall be filed with the registrar, which duplicate shall by him be transmitted to the licensing board or officer, who, upon receipt thereof, shall cause an investigation of the facts stated in the application for which he has applied, and said application is or will be suitable for the purpose of carrying on the licensed business. Permits for a change of situation or for additional licenses may specify all the premises of licensees for which he has applied, and said business may be carried on and regulate the situation of the premises of licensees within its jurisdiction by ordinance or by-laws which are hereby authorized to be made, and all licenses and permits issued hereunder to persons within said class 3 until otherwise provided. Except in the city of Boston, the licensing officer may, in his discretion, waive the annual hearing for renewal of a class 3 license, but no license shall be revoked by the licensing board or officer if it appears, after hearing, that the licensee is not complying with the rules and regulations of the registrar. In each such case such license shall be revoked, the licensing board or officer shall forthwith notify the registrar of such revocation. Any person aggrieved by any action of the licensing board or officer refusing to grant, or revoking a license for any cause may, within ten days after such action, appeal to any justice of the superior court in the county in which the premises sought to be occupied under the license or permit applied for are located. The justice shall, after such notice to the parties as he deems reasonable, give a summary hearing on such appeal, and shall have jurisdiction to review all questions of fact or law and may affirm or reverse the decision of the board or officer and may make any appropriate decree. Such parties shall have all rights of appeal as in other cases.

Important information for vehicle owners
- Certificate of Registration: Every person operating a motor vehicle shall have the Certificate of Registration for the motor vehicle and/or trailer, in the vehicle, in some easily accessible place. The records of the RMV constitute the official status of the vehicle registration.
- Change of Address: By law, you must report any change of address to the RMV within 30 days. Visit Mass.Gov/RMV to change your address. Once you have reported the address change to the RMV, please write corrected address in box provided above.
- No Insurance Card Required: Massachusetts law does not require an insurance card. M.G.L. Chapter 90, Section 34, and Chapter 175, Section 113A, requires the vehicle's owner to maintain a compulsory motor vehicle liability insurance policy or bond for bodily injury coverage and property damage insurance. The insurer is required by law to electronically notify the Registry of Motor Vehicles if coverage lapses. The vehicle owner is then notified by the RMV to obtain new insurance within 10 days or the registration will be revoked. Bonds are filed with the State Treasurer's Office.
- Transferring Your Plates: Massachusetts General Law (M.G.L. Chapter 90, Section 2) allows you to transfer valid registration plates from this vehicle to a newly acquired new or used motor vehicle or trailer while you obtain insurance and a new registration. See the Transferring a Registration Section on the RMV's website at Mass.Gov/RMV for more information.
- Cancel the registration plates if:
- The vehicle has been sold or junked and the registration is not going to be transferred to another vehicle.
- You move to another state and you register the vehicle in that state.
- The insurance policy is not renewed or is cancelled and there is no plan to obtain a new policy.

The Honorable City Council Beverly City Hall 191 Cabot Street Beverly, MA 01915
RE: Waiver of Right of First Refusal to purchase an Affordable Housing Ownership Unit at 348 Rantoul Street, Unit 202, Beverly, MA
Dear City Council:
I am respectfully requesting your consideration of waiving the City's First Right of Refusal to purchase a deed restricted affordable housing unit at 348 Rantoul Street, Unit 202 in Beverly. Chrissy Souhtworth, representing Federal National Mortgage Association (Fannie Mae), informed the City in writing of their intent to sell the affordable housing unit located at Dane Square Condominiums, 348 Rantoul Street, Unit 202 on August 18, 2026. A qualified appraisal was not provided at that time, which is required to be submitted with the Intent to Sell pursuant to the deed rider for the subject property.
A current and valid appraisal of the property was completed and received by the City on September 28, 2026. The appraisal determined the value of the unit to be $315,000. Consistent with the deed rider, the maximum resale price of the property is the greater of 80% of fair market value as determined by the appraisal or the price at which the unit was purchased for by the seller. In accordance with these provisions the maximum resale price is $252,000.
The City of Beverly has 30 days from the date of a complete notification by the seller (including appraisal) to inform the seller in writing whether the City shall exercise its right of first refusal to purchase the property and/or is proceeding to locate an eligible purchaser. If the City fails to notify the seller within the 30-day time frame, the seller may convey the property to any buyer, regardless of income, at a price not to exceed the Maximum Resale Price.
If the City decides not to exercise its option to purchase the property it must execute a "Waiver of Right of First Refusal." This waiver only applies to the current transfer of property and a waiver needs to be executed before any change of ownership in the future. By executing the waiver in a timely manner, the City also retains the ability to market the property to eligible purchasers, households with annual income less than 80% of the area median income (AMI). The City will have a period of 90 days from the date of notice from the seller to identify an eligible purchaser if the waiver is executed.
This property is unique in that a prior refinance did not comply with the affordable restriction. As a result, the foreclosure company agreed to comply with the deed restrictions at the time of their resale, as documented in a Waiver of Enforcement Rights (Book 39540, Page 084). This agreement states a commitment to "giving the requisite 30 day notice to the City of Beverly, advertising that the foreclosure sale will be subject to the restrictions and provisions of the Deed Rider, working with the City of Beverly to determine the affordable price calculation, and working with the City of Beverly to allow potential 3rd party bidders who attend the foreclosure auction to qualify as eligible purchasers."
I am forwarding the attached Waiver of First Right of Refusal to the Council for its consideration and respectfully request authorization for the Mayor to execute the waiver on the City's behalf. By executing the waiver the City will be able to work with the current property owner to identify and convey the property to an eligible purchaser. Also attached are the Waiver of Enforcement Rights and Property Deed.
Thank you for your consideration of this request. If you have any questions on the process or the waiver itself, please do not hesitate to contact me.
Respectfully submitted,
Darlene E. Wynne, AICP Director of Planning and Community Development

- Right of First Refusal: When the Grantee or any successor in title to the Grantee shall desire to sell, dispose or otherwise convey the Property, or any portion thereof, the Grantee shall notify the City of Beverly in writing of the Grantee's intention to so convey the Property ("Notice"). The Notice shall contain an appraisal of the Property acceptable to the City of Beverly prepared by a real estate appraiser acceptable to the City of Beverly and qualified to appraise property for secondary mortgage markets and recognized as utilizing acceptable professional appraisal standards in Massachusetts, and the Notice shall set forth the Discount Rate and the Maximum Resale Price of the Property. The "Maximum Resale Price" shall be the appraised value of the property as determined by the City of Beverly less the Discount of twenty (20%) percent. Within thirty (30) days of the City of Beverly's receipt of the Notice, the City of Beverly shall notify the Grantee in writing as to whether the City of Beverly shall exercise its right of first refusal to purchase the Property and/or is proceeding to locate an eligible purchaser of the Property. For purposes of this Rider, "eligible purchaser" shall mean a purchaser who satisfies the criteria set forth in city guidelines in effect at the time the City of Beverly locates such purchaser, and who is ready and willing to purchase the Property within a reasonable time after the City of Beverly notifies the Grantee that the City of Beverly located said purchaser.
In the event the City of Beverly notifies the Grantee that it does not intend to exercise its right of first refusal and/or proceed to locate an eligible purchaser or if the City of Beverly fails to notify the Grantee within said thirty (30) day period, the Grantee may convey the Property to any third party at a price not to exceed the Maximum Resale Price.
In the event the City of Beverly, within said thirty (30) day period, notifies the Grantee of the City of Beverly's intention to exercise its right of first refusal and/or locate an eligible purchaser, the City of Beverly may, within ninety (90) days of the date of its Notice to the Grantee, elect to purchase the Property itself subject to the restrictions herein contained and at the Maximum Resale Price or locate an eligible purchaser to purchase the Property subject to the restrictions herein contained and at the Maximum Resale Price. If more than one eligible purchaser is located, the City of Beverly shall conduct a lottery or other like procedure in the City of Beverly's sole discretion to determine which eligible purchaser shall be entitled to the conveyance of the Property at the Maximum Resale Price, subject to the restrictions set forth in
this Rider.
If an eligible purchaser is located or the City of Beverly elects to purchase the Property within said ninety (90) day period, the Property shall be conveyed to said eligible purchaser or the City of Beverly subject to the terms and restrictions set forth herein. If the City of Beverly and the Grantee fail to locate an eligible purchaser within the ninety (90) day period or the City of Beverly fails to notify the Grantee as to whether an eligible purchaser has been located and the City of Beverly elects not to purchase the property the Grantee may convey the Property to any third party at a price not to exceed the Maximum Resale Price.
- Resale and Transfer Restrictions: Except as otherwise stated herein, the Property or any interest therein shall not at any time be sold by the Grantee, the Grantee's successor and assigns, and no attempted sale shall be valid, unless the aggregate value of all consideration and payments of every kind given or paid by the eligible purchaser (as located and defined in accordance with Paragraph 1 above) to the then owner of the Property for and in connection with the transfer of such Property, is equal to or less than the Maximum Resale Price for the Property determined as of a date not later than the date of transfer or conveyance of title to the Property.
No conveyance, sale or transfer to an eligible purchaser (as located in accordance with Paragraph 1 above) shall be valid and be deemed in accordance with the terms of this Rider unless a certificate is obtained and recorded, signed and acknowledged by the City of Beverly or its agent or designee which refers to the Property, the Grantee thereof, the eligible purchaser thereof, the Maximum Resale Price therefor, and states that the proposed conveyance, sale or transfer of the Property to the eligible purchaser is in compliance with the restrictions contained in this Rider.
Any good faith purchaser of the Property, any lender or other party taking a security interest in such Property and any other third party may rely upon a certificate of the type referred to in this Deed and Rider referring to the Property as conclusive evidence of the matters stated therein and may record such certificate in connection with conveyance of the Property, provided that the consideration recited in the deed or other instrument conveying the Property shall not be greater than the consideration stated in the certificate.
Within ten (10) days of the closing of the conveyance of the Property, the Grantee shall deliver to the City of Beverly a true and certified copy of the deed of the Property as recorded, together with information as to the place of recording thereof in the public records. Failure of the Grantee, or Grantee's successors or assigns to comply with the preceding sentence shall not affect the validity of such conveyance.

The Honorable Beverly City Council Beverly City Hall Cabot Street Beverly, Ma. 01915
Dear Honorable Beverly City Council:
It is with a certain amount of sadness, that I respectfully submit a letter of "retirement" from my position as your City Council Budget/Management Analyst. Please be advised that my retirement date would be effective upon the appointment of my successor, or December 31, 2026, whichever date comes first. As previously discussed with President Flowers and Councilors, I am happy to provide transition services with your new Budget/Management Analyst in any manner you deem appropriate.
I have had the pleasure to serve as your Budget/Management Analyst for approximately ten (10) years, following my full-time retirement from the Commonwealth of Massachusetts. This experience has been extremely fulfilling both personally and professionally. I have come to appreciate the level of talent with the elected and appointed officials of the City of Beverly, and in many cases having developed permanent friendships.
A lot has happened during my tenure that I was happy to be a part of. These accomplishments belong to you, the City Council, and Mayor Michael Cahill and his administration. Some of these accomplishments include, but are not limited to ten balanced budgets; two bond rating increases; properly funding debt management to build a new Police Station and renovate City Hall; establishing Financial Policies; increasing reserves; improving Financial Forecasting; updating the City's Charter; enhancing the financial and operational components of the Beverly Regional Airport; and several other accomplishments too many to bring up in this letter. I enjoyed every moment of this experience.
I want to take this opportunity to thank former President Paul Guanci, current President Julie Flowers, as well as past and present Beverly City Councilors I have had the pleasure to work with. Further, thanks are extended to Mayor Michael Cahill, his Department Heads and staff, as well as the Beverly School Committee and staff. I want to note a special thanks to former City Clerk Wes Slate, and especially current City Clerk Lisa Kent and their respective past and present staffs for all their assistance over the years. Finally, I would be remiss if I did not mention a strong appreciation to Finance Director Bryant Ayles and his team. He and they have been instrumental in providing exceptional financial services, which has improved the quality of life for the City of Beverly. My apologies if I left anyone out.
In closing, I wish all the Beverly officials and residents the best in your future endeavors.
With appreciation,
Gerard D. Perry Beverly City Council Budget/Management Analyst

Treatment System Progress
- Building 3 Thermal Treatment
- Status: The selected remedy – thermal treatment – was presented in the Phase IV Remedy Implementation Plan (Part 1) and at the June 2023 public meeting. Upon design completion, drilling of thermal wells began in December 2023 and was completed in April 2026. Vapor extraction began in June 2026. Treatment equipment installation was completed in July 2026 at which time subsurface heating began.
-
Current and upcoming work: As of the end of September 2026, heating continues and the thermal treatment system has removed more than 3,000 pounds of volatile compounds from the subsurface. Heating is expected to continue to increase over the next several weeks to achieve operational subsurface temperature. A graph presenting contaminant mass removal and subsurface temperature is provided in Figure 1 (below).
-
Stream A Granular Activated Carbon Adsorptive Barrier
- Status: The selected remedy – a granular activated carbon adsorptive barrier – was presented in the Phase IV Remedy Implementation Plan (Part 1) and at the June 2023 public meeting. The carbon mats were installed in October 2023.
-
Current and upcoming work: Field inspections are performed routinely to assess the condition of the mats.
-
PSL-10 Subgrade Biogeochemical Reactor
- Status: The selected remedy – a subgrade biogeochemical reactor (SBGR) – was presented in the Phase IV Remedy Implementation Plan (Part 3) and at the November 2023 public meeting. Following its installation, operation of the SBGR began in April 2025.
- Current and upcoming work: The SBGR continues to operate. The most recent post-treatment sampling event took place in August 2026, and results will be provided in the February 2027 Phase IV Status Report.
Environmental Cleanup Update
150 Sohier Road Property, Beverly MA | FALL 2026
This annual fact sheet provides an overview of the status of environmental investigation and treatment of the former Varian Facility at 150 Sohier Road in Beverly, Massachusetts.
Varian Completes System Installation and Continues Environmental Treatment
Throughout 2026, the Varian project team continued to implement the environmental cleanup plan. This work has included continuing to operate existing treatment systems and beginning operation of new treatment systems for indoor air, soil, shallow groundwater, and bedrock groundwater at the former Varian Site.
The Site environmental remedies include five treatment areas (Figure 1):
- PSL-10 (Open Field) Source Area
- Bedrock near Buildings 3 and 5
- Building 3 Source Area
- Stream A Seep
- Building 5 Source Area
In 2026, two new treatment systems started operation – injection treatment below Building 5 (spring 2026) and the thermal system below Building 3 (summer 2026).
A Temporary Solution Statement was submitted for the former Varian Site in February 2024 to the Massachusetts Department of Environmental Protection (MassDEP). This statement, prepared by a Massachusetts Licensed Site Professional (LSP), demonstrated that the Site does not pose a human health risk, but that treatment needs to continue to achieve a Permanent Solution. Sampling results from the Site continue to support this conclusion. The remedies being implemented are expected to accomplish the additional treatment needed for a Permanent Solution.
Public updates occur during the year through Public Involvement Plan and Technical Advisory Group meetings. In addition, the Varian project team submits Phase IV Status Reports twice a year in accordance with MassDEP requirements, as well as monthly updates distributed to the public mailing list and posted on the project website (https://beverlysitecleanup.com/). Varian is continuing to work actively with the Beverly community and MassDEP to achieve a Permanent Solution at the site.

Site History and Overview
The former Varian Facility, located at 150 Sohier Road, is currently owned by another firm and operates as an active manufacturing facility for microwave and radar products. The 150 Sohier Road property has been used as an industrial facility since the early 1950s. Industrial solvents were released to the environment due to the chemical handling and disposal practices that were common at the time, before stricter environmental regulations were enacted. These solvents, used primarily for surface treatment, cleaning, and degreasing operations, included trichloroethene (TCE), perchloroethene (PCE), and 1,1,1-trichloroethane (TCA). Releases of these solvents occurred in three main areas: the Building 3 area, the Building 5 area, and an open field known as potential source location (PSL) 10. TCE, PCE, and TCA are heavier than water and have limited ability to dissolve in water. They also tend to evaporate easily and are referred to as volatile organic compounds (VOCs). Varian, with support from Jacobs Solutions, has investigated and is actively cleaning up the Site in accordance with Massachusetts regulations, known as the Massachusetts Contingency Plan (MCP). The Site is listed by MassDEP as Site Number 3-0485.
